| dc.description.abstract | Divorce will make some various legal effects either for the former couples, property or for their child. There were many suffered that caused by the divorce, so that Rasulallah SAW said "an allowed action the God extremely hate is a divorce". According to the customary law, a divorce is a social and juridical problem which should be avoided. Principally, every family, relative and society wish to maintain their marriage forever. The duty to custody of the child, educate, and manages the child's property should be carried out for the sake of child and these should be continuously done even though the marriage has been dissolved (the act number 45 of 1974). The research was proposed to solve the problem regarding parental authority of the the child, factors that make parents neglect their duties to their children, and affords which are taken to get legally their children rights.
This research entitled "Parental Authority of their Children after having Divorce" which is take placed in Pidie Regency, Daerah Istimewa Aceh Province, is an analytical descriptive observation by using sociological legal approach. The respondents consisted of 80 married and 16 who have ever divorced determined purposively. The data was collected by using either an observation method, questionnaire or interview. Data analysis was qualitative and supported by quantitative data, then representated in frequency table, using both deductive and inductive methods, and then discussed by comparing to the prevailing law. | en_US |
