The objectives of this research are to identify
what contractual law principles are available to business
format franchising and to determine whether or not
a business format franchising contract is a sui generis
contracts that related to various things regarding the
ownership of intelectual property. This research constitutes
a normative law research which has the explorative
descriptive character. The emphasis is the abstract side
at any legal issue regarding economics activity in term
of trade using the business format franchising.
The population of business format franchising is
unknown. In this research we observed 24 franchised
independent business entities with different name or
trade mark. The number is relatively small, less than
30, that make every business entity to be a
representative sample. We determine sample purposively
and the sample size is 24. Additional respondents are
Trade Department, Culture and Education Department,
Tourism, Post and Telecommunication Department, and
Chamber of Commerce. Primary data was collected by using
questionaires and interviews, while secondary data was
collected by doing a library research. Collected data
are analyzed descriptively.
