    Abstract
    This article inhibit for new building of palm oil mills and detrimental to the people. Results of palm plantations have to be transported away and the costs are borne by the people themselves. Other than that the people have only as a supplier of raw materials alone to palm oil mills. Environmental responsibility is not expressly presented in the regulation. Laws must bring fairness, certainty and protection for businesses. Therefore, the government has replaced the Minister of Agriculture Regulation No.26 / 2007 to Pennentan 98/2013. Where the articles do not provide justice, protection and certainty in the attempt has been replaced. Development of new oil palm factory without gardens have been allowed on the condition that the statement that there are no available land to build a new oil palm plantations and there is a written agreement between the company and continuing cooperation of the people for the procurement of raw materials. Apart from that employers are required to facilitate a community of oil palm plantations at least 20% of the processing capacity of the plant is installed. Another obligation towards social responsibility and the environment in which the industry is built. The most meggembirakan is that the company is obliged to sell shares to the public through cooperative factory garden at least 5% in the first year and gradually 30% up on the year to 15. The Government in its role as mandatory to issue a business license to processing plantation should be based on the principles of transparency, accountability and good governance to serve the community. Labuhan Batu Utara of district government has sought to develop the people's economy through Pennentan 98/2013. Already there are three units of the oil palm mill without palm palntation self given license, this development gives the advantage to the people as a result of oil palm plantations can be delivered to people near the plant spacing, the company will facilitate people's estate, the environment and social got the attention of the company and the people have the opportunity for oil mill's hold share. But the Labuhan Batu Utara of district government does not show transparency and accountability in the issuance of business licenses. Lack of transparency in licensing fees, lack of transparency in the information and time to take care of. Also licensing not yet to implement in one gate system through existing licensing office builded.
