Kajian tentang Aspek Hukum dari Perjanjian Franchising dan Permasalahannya (Studi Kasus di DKI Jakarta)

Abstract

 The Franchising agreement constitutes one of tied forms of cooperation relationship on business work either producing goods or service. Therefore, on globalization agreement subjects to this Anglo Saxon legal system, perhaps many applied to various business activities in Indonesia, with either business cooperation conducted by foreign franchisor and domestical franchisee, domestical franchisor and foreign franchisee or domestical franchisor and domestical franchisee. If seeing the growing of franchise legal institution, there found various types or forms of franchise. The existence of regulations adopted specifically regulates about franchise in Indonesia is not found yet. Then, it appears any problem, as aimed within this re- search, namely about the implementation of franchising agreement in Indonesia, the character of its legal, the relationship legal those parties, legal regulation base it on and franchising projection in Indonesia. In order to reply the problem above, establishing a research with the location of Jakarta capital the center of business activity. The research type employed in this case is a case study in research with the taking sampling technique of non probability sampling. Taking this sample technique to be employed considering complete list of corporations which the activity included to franchise field in Jakarta city unknown.
