The crime of embezzlement has always existed in society, and even tends to
develop in society along with technological and economic advances. One of the
modes of embezzlement crime is embezzlement in office. This study focuses on
analyzing the decisions of embezzlement cases in credit cooperatives in Karo
Regency, with the aim of analyzing the application of law in court decisions against
criminal acts of embezzlement in positions in credit cooperatives and efforts to
overcome criminal acts of embezzlement in positions at credit cooperatives in Karo
Regency. This research is a normative legal research with a statutory approach and a
case approach. The data used is secondary data consisting of primary, secondary and
tertiary legal materials collected using library research techniques. All data were
analyzed by qualitative data analysis method. Based on this study, it was concluded
that the application of the law to criminal acts in Decision Number
354/Pid.B/2013/PN.Kbj, namely the Public Prosecutor ensnared the defendant under
Article 374 of the Criminal Code, namely embezzlement in office. The imposition of
criminal sanctions carried out by the judge against the defendant on the demands of
the public prosecutor against article 374 of the Criminal Code is appropriate
because the elements contained in the juridical provisions regarding embezzlement
have been fulfilled both objective and subjective elements. The efforts to overcome
the crime of embezzlement of positions in credit cooperatives in Karo Regency can be
carried out non-penally by optimizing the Sikundo application in credit cooperatives,
where in the system it will monitor what transactions will be carried out by
cooperative members and can be accessed by all cooperative members. , the welfare
of the members of the cooperative in the cooperative. Meanwhile, penal or repressive
countermeasures in criminal acts of embezzlement in credit cooperatives can be
carried out by submitting cases of criminal acts that have occurred to law
enforcement.
