POJK No. 61/POJK.07/2020 concerning Alternative Dispute Resolution
Institutions (LAPS) for the Financial Services Sector which is a refinement of POJK
Number 1/POKJK.07/2014 was issued in order to realize a more effective and efficient
LAPS for the financial services sector, as well as responding to technological
developments, financial products and services that are increasingly complex and
across the financial services sector. However, the presence of LAPS- SJK is often
suspected as a form of lex specialis from BPSK to handle disputes specifically between
financial services business actors (PUJK) and consumers of the financial services
sector. In this regard, this research is intended to analyze more deeply the role of the
Financial Services Authority in providing protection to consumers in the financial
services sector, legal certainty in resolving consumer disputes in the financial services
sector by BPSK, and the issue of BPSK's authorityto resolve disputes in financial
services after the formation of POJK No.61 /07/2020.
This research is a normative legal research (normative juridical). The data
used is secondary data collected by using library research techniques. All data were
analyzed by qualitative data analysis method.
Based on this research, it is concluded that BPSK is not authorized to settle
disputes in the financial services sector after the establishment of POJK No.
61/07/2020. This is because the BPSK formulated by the UUPK has general authority
regarding the settlement of consumer disputes related to goods and/or services, while
the Financial Services Sector LAPS established by the OJK can only resolve disputes
in certain service sectors, namely financial services.
