dc.description.abstract | Premediated murder is a criminal act that is considered a serious crime,
because this crime has killed the lives of others. The act of premeditated murder
which is sentenced to life is seen by some as a punishment, but many also consider
that life imprisonment is a severe punishment for perpetrators of premeditated
murder. Planned murder in law is generally the most serious type of murder, in
addition to being threatened capital punishment, perpetrators of criminal acts of
premeditated murder can also be sentenced to life imprisonment or for a specified
period of a maximum of twenty years. In this case the policy on life imprisonment in
the existing Indonesian criminal law has not implemented the idea of Indonesian
justice. The non-implementation of the values of balance in life-long crimes has made
life-long crimes in Indonesia 's criminal legislation policy unable to provide a
balance of protection for individuals and the community.
This study is a Normative Juridical Study. The nature of the research is
analytical descriptive. The type of data used is secondary data sourced from primary,
secondary, and tertiary legal materials. Secondary data is collected by literature
study techniques. Furthermore,the data are analyzed using qualitative analysis
methods. .
Research results indicate that : Not all criminal acts of murder can be categorized as
criminal acts of premeditated murder and not all criminal acts of murder are planned
to be sentenced to life long murder in the Act. | en_US |
