Kajian Hukum terhadap Pelaku Tindak Pidana Kejahatan Tentang Eksploitasi Anak yang Dilakukan oleh Orang Tua Kandung terhadap Anak (Studi Putusan Nomor 235/PID.SUS/2021/PN KLK)

Abstract

Sexual exploitation of children is a basic violation of children's human rights consisting of sexual violence by adults and the provision of money or something valued in money where the child is used as a sex object utilizing the sexual organs or other organs of the child for profit. This research aims to analyze the legal review on the criminal act of exploitation committed by biological parents against children in Kuala Kapuas Court Decision Number: 235/Pid.Sus/2021/Pn.Klk. The research uses normative juridical research. This research uses a statute approach. The data source used is secondary data, which consists of primary, secondary, and tertiary legal materials. Data collection is done by means of a literature study (library reseacrh), then processed and analyzed using qualitative method analysis techniques. Sexual exploitation committed by parents against children is regulated in Law Number 35 of 2014 Amendment to Law Number 23 of 2002 concerning Child Protection. With this, law enforcement, government and other state institutions are obliged to provide law enforcement against perpetrators and special protection for child victims of exploitation. The consequences arising from the crime of child exploitation cause the child's future to be destroyed and physical / physical damage to the child who is the victim of exploitation.
