Notary has separate duties and function based on applicable legislation Natary works for and to the interest of the Public hosh Nation and Country in accordance to the regulations of the Lane of Notary Positions No.30 of 2004. In carrying out the profession, a Notary opens up an office shat requires other people as the assistance or needs employees so carry ost the profession. However in executing their profession a Notary keep neglecting other Legislation, which is the Legislation of Employment related to the workers' rights as employees in the office, salary below the Regency/City Minimum Wage (UMK). The thesis certainly discusses the regulation of the rights and obligations of Notary's employees based on the applicable Legislation as well as the application of the minimum wage, and sanction imposed to the Notary if they continue to provide wages belaw the minimum wage that has been stipulated by Pekanbaru City Government.
This is an empirical juridical legal research with descriptive type to gain thorough and systematical description concerning minimum wage of employees who work in the Notary office. The data are obtained from secondary and primary data by collecting primary, secondary and tertiary materials as well as carrying out interview directly to the respondents.
Result shows that there is no Legal Regulation explicitly regulates the rights and obligations of Notary's employees or workers, but implicitly the Notary can refers to the provision of the Employment Law No.13 of 20013 and also guided by the Decree of Rin Governor No kpts 1198. 11. 2019 concerning the 2020 Minimum Wage for the Municipality of Riau Province, that says the standard of salary in Pekanbaru City is IDR 2,997,971 (two million mine hundred ninety seven thousand nine hundred and seventy one). Meanwhile there are many Notaries who violate and ignore the applicable rules in Granting and Implementing Normative Rights to Employees Workers at the Notary Office of Pekanbaru City, in which the Notary has certam considerations and reasons thai the status of a Notary is as an employer not an entrepreneur. Finally, a form of sanctions that can be imposed on the Notary when they do not apply the standard of monomum wage to those who work in the office is in the farm of criminal
The research concludes that a Notary should provide salary in accordance to the UMK, as UMK is a standard that is stipulated based on decent living needs. and also regulated amplicity in other Legislation that resulted the employers are prohibued to provide wages below the minimum wage that has been determined In order for this can be realized it is advised that there should be special regulation in the Lane on Notary Posicions related to woges, then it is recommended to the Head of Regional Supersary Council especially im Pekanbaru city to supervise or warn the Notary whom turn out to provide wages helow UMK even though it is mat the mom deties nor functions of the Regiomal Supervisory Council
