Abstract

It is often found in the Chinese community in Bagersiapiapi who get married according to their bellef without registering in the Registrar Office. When one of the morried couples dies, the children will get trouble in getting imhertiance from their fother since they do not have any legal relations their father

The objective of the research was to find out the mechanism of recognition of a child from wregistered marriage, the position of inheritance of the child of the registered marriage in the Chinese community, and the legal protection for his inheritance right. The research used empirical study approach which was aimed to find out directly the problem in the Vihara, the Residential Agency and Civil Registry Office, and the Nourial Office in Bagansiapiapt. The result was gathered and explained to answer the problema above and constructed, using Herature review

The result of the research shows that the mechanism was done for the recognition of the child of the Chinese community who was born from an unregistered marriage in Bagaraiapiapi. Consequently, the position of the child at the heir of his biological father's inheritance was uncertain. There are some legal protection for the inheritance right of the child in the Clainese community whose parents marriage is held according to their tradition.
