dc.description.abstractThe problem of overcapacity had previously been addressed with a policy of increasing building capacity and social sanctions, but because it did not work effectively, another alternative policy was initiated, namely the Restorative Justice policy. The aim of this research is to examine and analyze the implementation of alternative policies to overcome overcapacity in the Class IIA Tanjung Gusta Women's Correctional Institution, Medan City. The method used in this research is descriptive with a qualitative approach. Data collection was carried out using interview, observation and documentation techniques. The data obtained were analyzed qualitatively using the Implementation theory approach proposed by Edward III including Communication, Resources, Disposition and Bureaucratic Structure. In this research, to check the validity of the data, researchers focused more on comparing observational data with interview data. The results of the research show that the communication channeling carried out by the Prisons, Police and Medan District Attorney's Office in implementing alternative policies, namely Restorative Justice, can be said to be good and clarity in the implementation of alternative policies is correct considering the many good impacts produced such as overcoming overcapacity and consistency of communication in implementation. The alternative policy has been running effectively because each person knows their duties, but from the prisoner's point of view, communication is still not good. Furthermore, Human Resources in the Class IIA Tanjung Gusta Women's Prison can be said to be quite good in terms of the number of personnel and skills possessed. The Human Resources assigned to the implementation of Restorative Justice from the Medan District Prosecutor's Office also do not experience a shortage of personnel in terms of numbers or skills. The authority to implement Restorative Justice policies is based on their respective duties, this authority has been regulated in Law No. 1 of 2023 concerning the Criminal Code and Regulation of the Head of State Police Number 8 of 2021. Then the attitude shown by the implementers is quite good and the results of the interview are different from the prisoner's opinion stated that the attitude of the prison officers was not good. Finally, prison officers do not know whether the SOP for implementing Restorative Justice exists or is needed, because until now they have never received it, nor does the Medan District Prosecutor's Office where the prosecutor and judge also do not know that there is an SOP because they usually do it based on a request from the police to carry it out. Restorative Justice. There is no SOP available because Restorative Justice is an alternative policy and not a program that should have an SOP.en_US
