Konstruksi Pemberitaan Media Terkait Dugaan Pelanggaran Undang-Undang Informasi Transaksi Elektronik pada Permasalahan Pencemaran Nama Baik dan Tindak Kriminalisasi pada Pers (Studi Kasus Wartawan Aliansi Jurnalis Independen Kota Medan)

Abstract

This study is entitled "Construction of Media Coverage Related to Alleged Violations of the Law on Electronic Transaction Information on the Problem of Defamation and Criminalization in the Press (Case Study of Journalists' Alliance of Independent JournalistsMedan city)".the purpose of this study is to find out how the construction of news from the media that violates Law No. 11 of 2008 which was changed into Law No. 19 of 2016 concerning Electronic Transaction Information (ITE) article 27 paragraph 3 concerning defamation, namely news from the media Sorotdaerah.com. Second, to find out the relationship between Law No. 40 of 1999 with Law no. 11 of 2008 which was changed into Law No. 19 of 2016. Third, to find out how advocacy assistance from the Alliance of Independent Journalists (AJI). This research uses a constructivist paradigm that aims to understand reality that is not as it is, but everything that is behind it. The methodology used is a qualitative methodology in which researchers conducted in-depth interviews with four informants, namely the North Sumatra Press Expert as well as the former Chairman of the AJI for the 2015-2018 period, the North Sumatra Regional Police Head of Public Relations, the Chair of the AJI for 2018-2021 and Principal Director of Sorotdaerah.com. The theory used to complete this research is the Social Responsibility Press Theory.based on the focus and purpose of the study, the results of the study can be concluded as follows: 1) Sorotdaerah.com seeks to fulfill the principle of balance 2) Freedom of the Press as stipulated in the Press Law which is often disputed with The Electronic Transaction Law can be mediated by a memorandum of understanding between the Press Council and the National Police. 3) Case accompaniment by AJI found that procedural errors led to the criminalization of the press.
