Abstract

The use of sophisticated technological tools in uncovering criminal acts is a service of the Police to the community based on technology and knowledge. All units and units within the ranks of the Medan City Police Resort to the maximum extent possible in using technology and information in accordance with the demands of their duties. The use of high-tech tools to assist the Police Criminal Investigation Unit to uncover criminal acts is the "Direct Finder" and "Cellebrite UFED 4PC" which are digital forensic tools. there are legal issues regarding how the law views investigations and investigations using high-tech tools in uncovering cases of theft crimes at the Medan City Police Resort, what is the legal basis, how it is implemented, and how the obstacles faced by investigators of the Criminal Investigation Unit of the Medan City Police Resort, and what efforts are being made to overcome these obstacles. Legal issues will be raised as problems in this research. This research is normative juridical research. The nature of the research is descriptive analysis. A research approach is a statutory approach. The data used are sourced from secondary data and primary data. Secondary data was collected by using library research techniques with data collection tools in the form of document studies. Primary data was collected by using field study techniques and the data collection tool was interviewed. Interviews were conducted on informants, namely the Medan Police Criminal Investigation Unit. With qualitative analysis, conclusions are obtained, as follows: 1) Arrangement of investigations and investigations using high-tech tools in uncovering cases of motor vehicle theft crimes at the Medan Police Criminal Investigation Unit aims to make it clear and clear that a criminal act must be carried out according to applicable legal procedures. Article 5 of the Electronic Information and Transaction Law and its Elucidation is that as the basis for a call data record, it is categorized as electronic information which is an extension of legal evidence. The affirmation of the validity of electronic documents and electronic information as evidence is increasingly emphasized by the amendment of the Electronic Information and Transaction Law in its Elucidation; 2) The implementation of the investigation and investigation by the Medan Police Criminal Investigation Unit in using high-tech tools to uncover cases of motor vehicle theft crimes is in terms of using the cell dump data technique to track the position of the perpetrators of the crime of motor vehicle theft; 3) Obstacles and Efforts Medan Police Criminal Investigation Unit in carrying out investigations and investigations using high-tech tools to uncover cases of motor vehicle theft crimes in Medan City, in terms of legal system theory: a. Legal Structure: barriers to the use of electronic evidence require expert testimony. The effort is, that the Medan Police Criminal Investigation Unit should facilitate the use of the digital forensic expert; c. Legal Culture: the obstacle is the existence of a bribery culture in serving whistleblowers. The effort is recommended to the Medan Police Criminal Investigation Unit to serve every reporter by upholding the principle of equality before the law.
