This agreement is outside the Civil Code, based on Article 1338 of the Civil Code. The problem formulation in this research is: How to organize cooperation in managing angel tourism objects in Pamah Simelir Hamlet, Telagah Village, Sei Bingai District, Langkat Regency; What is the form of an unwritten agreement made between the rice field owner and the angel tourism manager in Pamah Simelir Hamlet, Telagah Village, Sei Bingai District, Langkat Regency, seen from contract law in Indonesia; Is the agreement between the owner of the rice field and the manager of the Bidadari tourist attraction in Pamah Simelir Hamlet, Telagah Village, Sei Bingai District, Langkat Regency, Implementing the Principle of Justice to Guarantee the Interests of the Parties?
The research method used in this research is empirical juridical research, which is supported by primary and secondary data sources, and qualitative analysis is carried out.
The results of the research and discussion are that the cooperative arrangements for managing the Bidadari tourist attraction in Pamah Simelir Hamlet are carried out through an unwritten agreement whose validity is still recognized as long as it meets the requirements of Article 1320 of the Civil Code and is subject to the provisions of Book III of the Civil Code concerning Engagements, in particular Article 1314 of the Civil Code concerning burdensome agreements. . However, the implementation of this agreement has not fully implemented the principle of justice in guaranteeing the interests of the parties, as can be seen from the existence of problems such as the lack of responsibility of tourism managers in maintaining the cleanliness of rice fields and non-transparency in reporting income, so that improvements are needed through clearer and firmer regulations regarding rights. and obligations of the parties, increasing transparency, and fair dispute resolution in accordance with the law. | en_US |
