Implementation of Omnibus Law Method in The Process of Lawmaking In Indonesia
Abstract
The term omnibus in Indonesia became known after the Job Creation Bill
was passed into law. The Omnibus Law method focuses on simplifying the
number of regulations because it revises and revokes many laws at once. The
problem of over- regulation and overlapping laws is the forerunner of Law No.
13 of 2022, which introduced the omnibus method. The formulation of the
problem in this writing includes how the urgency of the omnibus law method in
the formation of laws and how the implementation of the omnibus law method
before and after the enactment of Law No. 13 of 2022 which aims to find out
what is the urgency and how the implementation of the omnibus law method
before and after the enactment of Law No. 13 of 2022.
The method used in writing this thesis is normative juridical using a statute
approach, and a conceptual approach. The author uses secondary data
consisting of primary legal materials, secondary legal materials, and tertiary
legal materials. The data collection technique uses literature studies and
internet searches that analyse laws and regulations, book literature and other
materials.
The urgency of the omnibus law method in the formation of law in
Indonesia is to overcome the problems of legislation caused by obesity of
regulations and disharmony between laws and regulations. The same is the case
with the adoption of the omnibus law method in the formation of the Job
Creation Law. Prior to the enactment of Law No. 13 of 2022 there was no
omnibus regulation in Indonesia. But historically, the practice of omnibus law
has been done. The enactment of Law No. 6 of 2023 on the Stipulation of
Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation into Law,
errs in the use of the omnibus method and violates the procedures as stipulated
in Law No. 13 of 2022.
