Socfindo is about 472 hectares, the people of Simpang Gambus village have been demanding land rights since 1977, long before the expansion of Coal Regency. In the view of administration, this phenomenon can be associated with management (management), namely as a form of resolving agrarian conflicts. Land disputes that occurred between PT. Socfindo and the Simpang Gambus Village Struggle Land Farmers Group have not yet found a bright spot, and it is even feared that there will be a prolonged conflict.
This study aims to analyze the Governance of the National Land Agency of Coal Regency in Resolving Agrarian Conflicts of Business Use Rights and to determine the factors that become obstacles in resolving land disputes that occur between PT. Socfindo and Simpang Gambus Farmer Group. This research was conducted at the Office of the National Land Agency (BPN) of Coal Regency and the location of HGU Land which became a dispute in Simpang Gambus Village, Fifty District, Coal Regency. The research method used in this study is a descriptive method with a qualitative approach. The sampling technique to explore the information that will be the basis of this study uses the Purposive Sampling technique. In this study the authors used types of data triangulation and triangulation methods to validate the data.
The results showed that the cause of the conflict over land use rights (HGU) disputes of PT. Socfindo with Simpang Gambus Farmer Group due to the excess area of land cultivated by PT. Socfindo covers an area of approximately 472 Ha. Implementation of governance of the National Land Agency (BPN) of Coal Regency in resolving agrarian conflicts of Business Use Rights (HGU) PT. Socfindo with the Simpang Gambus Farmer Group has so far been accountable and transparent, in addition to governance in accordance with predetermined legal provisions However, the implementation of management still does not show dominant participation and the role of BPN Coal Regency is still not effective, because the resolution of this conflict is still unresolved. The obstacle in resolving this case is because both sides still insist on maintaining their arguments. Pihak PT. Socfindo preferred to take the case to court while the community and the Simpang Gambus Village Farmer Group asked the Coal Regency Government not to recommend the extension of PT.
