dc.description.abstractCredit that is guaranteed by Mortgage Rights, if during its journey it turns out that the debtor is in default/default, namely the debtor is unable to pay off his debt to the bank concerned and in the end it becomes bad credit, then the quickest effort for the bank as a creditor to resolve the bad credit is to selling Mortgage Rights objects at the local KPKNL. The problem formulation in this thesis is: What is the mechanism for resolving credit bottlenecks that are tied to mortgage guarantees with voluntary sales at the BRI Padangsidimpuan branch; What are the legal provisions for resolving bad debts that are tied to mortgage rights that are sold voluntarily; What factors are the obstacles to resolving credit bottlenecks that are guaranteed by mortgage guarantees through voluntary sales at BRI Padangsidimpuan Branch. The method used in this research is normative juridical research, namely a method referring to legal norms which is carried out by means of literature study in order to obtain secondary data in the form of primary, secondary and tertiary legal materials related to the problems studied. This research has a descriptive nature. analytical. Writing research through regulations and legal materials related to this writing, in research conducting field studies at PT. BRI Padangsidimpuan branch, the data analysis method used is a qualitative method obtained from interviews with PT. BRI Padangsidimpuan branch. The research results found that the legal provisions for resolving bad debts which are tied to mortgage rights sold voluntarily are related to the execution of mortgage rights objects. Mechanisms and procedures for resolving bad debts tied to mortgage rights sold voluntarily at PT. BRI Padangsidimpuan Branch in problem loans, the bank can take two methods or strategies, namely credit rescue and credit settlement. Obstacles that arise in the process of executing this voluntary sale, when the execution occurs, the debtor changes his mind/is uncooperative and does not want the mortgage object to be sold immediately, the debtor is complicated in carrying out the execution through a voluntary sale to resolve bad credit.en_US
