Permission is an agreement from the authorities to deviate under certain
circumstances from the prohibitive provisions of statutory regulations. Business licensing for the construction services subsector is a legality given to business actors (individuals or construction companies) to start and run a construction
services business. After the issuance of Job Creation Act, PT. Jonathan in obtaining
a business licensing experienced obstacles where after changes to the permit
obtaining procedure it turned out that it took longer to process the release of the
Enterprise Certificate. The issues raised in this thesis are : What are the regulations regarding business licensing for the construction services subsector in the government administration system after the enactment of Act Number 6/2023 on
Job Creation, What are the procedures for obtaining business licensing for the
construction services subsector at PT. Jonathan Medan, What are the obstacles and solutions in obtaining a business licensing for the construction services subsector at
PT. Jonathan Medan. Based on the issues raised in this thesis, the author gave the title of this thesis Juridical Review of Procedures for Obtaining Permits to Establish Construction Company of PT. Jonathan Medan. The research method used in this
thesis is a normative legal research method by examining library materials which include books and legal norms contained in statutory regulations. The writing of
this thesis is descriptive and the primary data used was obtained through field
research in the form of interviews at PT. Jonathan Medan. The research result obtained from this thesis show that the procedures for obtaining business licensing for the construction services subsector are regulated in Government Regulation Number 5/2021 on Risk-Based Business Licensing. There are obstacles in obtaining
business licensing for the construction services subsector through the Online Single Submission Risk Based Approach (OSS-RBA) system, which in practice takes longer than the previous system, as well as the use of applications that are not yet understood by all construction service business actors. Socialization, system
improvements and clear application of features are needed to facilitate the
implementation of business licensing.
