dc.description.abstract | Personal Data Protection is an overall effort to protect a person's personal data in the process of processing personal data in order to guarantee the constitutional rights of personal data subjects. Previously there were no regulations that significantly regulated the protection of personal data until Law Number 27 of 2022 concerning Personal Data Protection was issued. However, currently there is a lot of misuse of personal data that is not in accordance with the mandate of the law. The issues raised are: first, regarding the regulation of personal data protection as a constitutional right of citizens according to statutory regulations; second, the form of protection of personal data for citizens in the Political Party Information System (Sipol); third, resolving disputes between the community, political parties and the Independent Election Commission (KIP) of Pidie Regency regarding the protection of personal data. The research method used in writing this thesis is normative and empirical using a statute approach and a case approach. Data collection was carried out through library research and field research, then data analysis was carried out qualitatively using the deductive method of drawing conclusions. The research results show that Law Number 27 of 2022 regulates the Protection of Personal Data, and the protection of personal data is a manifestation of the State's constitutional obligations which are regulated in the 1945 Constitution in Article 28G paragraph (1). The forms of personal data protection in the Political Party Information System (Sipol) include supervision of participatory programs by Bawaslu, strict sanctions against NIK profiteering in Sipol, and socialization of the importance of NIK checks. Resolving community and political party disputes by KIP Pidie Regency regarding the protection of personal data included in Sipol includes complaints from the public, filling out the complaint form provided by KIP or Bawaslu, waiting for the complaint to be processed; and the public received a certificate that there was no indication of political party membership in the political party information system (Sipol). | en_US |
