dc.description.abstract | This study analyzes the implementation of the regulation on Individual Companies according to Law Number 6 of 2023, which establishes Gpvernment Regulation in Lieu of Law Number 2 of 2022 on Job Creation in the development of micro and small enterprises (MSEs) in Medan City. The issues addressed in this research are ; How are Individual Companies regulated under the Job Creation Law, specifically concerning the category of micro and small enterprises? How is the practice of regulating Individual Companies under the Job Creation Law related to the development of MSEs in Medan City? What factor influence the achievement or non-achivement of the objectives of the Individual Company regulation under the Job Creation Law in relation to the business activities of MSEs in Medan City?
This research employs an empirical legal research method with a descriptive-analytical approach. Data sources invlude primary data from interviews with officials from the Ministry of Law and Human Rights, North Sumatra Regional Office, the Department of Cooperatives and SMEs of Medan City, and selected MSE actors in Medan City through purposive sampling. The collected data are qualitatively analyzed, and conclutions are drawn using deductive reasoning.
The implimintation of the regulation on Individual Companies under the job Creation Law appears very effective at first glance because the process of establishing an Individual Company is greatly simplified. However, upon further examination, it becomes clear that the regulation is not yet optimal. Banks are reluctant to provide credit to Individual Companies due to their one-tier system. MSEs that exceed the MSE turnover threshold cannot transfer their data to upgrade to a capital partnership PT; instead, the Individual Company must “dissolve” and then from a new capital partnership PT from scratch. Therefore, the implamantation of the Individual Company regulation does not support the “upgrading” of MSEs. | en_US |
