This research aims to analyze the legal policies of the National Economic Recovery (PEN) and assess its implementation on Micro, Small, and Medium Enterprises (MSMEs) in the city of Medan post-pandemic. The study addresses three main issues: First, the legal policy regulations of the National Economic Recovery concerning the development of MSMEs post-COVID-19; Second, the implementation of the National Economic Recovery policies on MSMEs post-COVID-19 in Medan; and third, the role of the Local Government of Medan in supporting the development of MSMEs through the National Economic Recovery policies.
In addressing the aforementioned issues, a normative legal research method supported by empirical data was employed, characterized as descriptive. Data were sourced from legal materials gathered through a literature review (library research) and the results of field research involving interviews with the Cooperative and SME Agency of Medan City and selected SMEs in Medan using purposive sampling. Subsequently, the collected data were qualitatively analyzed, and conclusions were drawn using deductive reasoning.
The research findings indicate that: First, the legal policy regulation related to the National Economic Recovery post-COVID-19 pandemic, as stipulated in Law No. 2 of 2020, presents several issues and potential impacts on national economic development, particularly in the context of SME development. Second, the Medan City Government has made various efforts to enhance the quality and competitiveness of SMEs in Medan. These efforts include: Capital assistance to increase the production capacity of SMEs; Training and mentoring to improve the skills and knowledge of SME stakeholders; Simplified licensing procedures to facilitate SME operations; Marketing assistance to expand SME market access. These efforts have had a positive impact on the development of SMEs in Medan. Third, in implementing PEN policies at the local level, the Medan City Government faces various challenges in the legal system, namely: substantial constraints related to the unclear and precise definition of National Economic Recovery in Law No. 2 of 2020 and its derivative regulations; structural constraints: ambiguity in task allocation and responsibilities; cultural constraints: limited legal awareness and reluctance of business actors to transition to digital marketing. Recommendations include: The government improving the legal framework of National Economic Recovery for clarity; the Medan City Government enhancing cooperation among its subordinate agencies, establishing collaborative relationships with banks, and providing training.
