Analisis Hukum Hak yang Berkaitan dengan Hak Cipta (Neighbouring Rights) terhadap Hak Moral dan Hak Ekonomi Penyiaran Ulang Siaran Piala Dunia Tahun 2022 yang Ditayangkan oleh Stasiun Televisi di Indonesia

Abstract

Neighbouring Rights is one of the exclusive rights within the scope of Copyright related to Performers, Phonogram Producers, and Broadcasting Institutions. Broadcasting Institutions are broadcasting organizers and in the implementation of a broadcast, broadcasting rights are required, which is a permit that must be owned by broadcasting operators in their broadcasting activities. Broadcasting activities broadcast by Indonesian television stations have Moral Rights and Economic Rights. Moral rights are sovereignty that will always be attached to the creator, while related to economic rights is the economic use of a creation. The research method used in this study is a normative library research method, which is research on how to collect secondary data, which consists of primary, secondary, and tertiary legal materials. The procedures for organizing international television broadcasting in Indonesia are carried out by granting permits and based on the provisions of the Law. Regarding the moral and economic rights of television broadcasting in Indonesia, it is the right to carry out by oneself, give permission, or prohibit other parties from rebroadcasting, broadcast communication, broadcast fixation and/or reproduction of broadcast fixation and is related to the rights that are permanently attached to the creator of the Legal Analysis of Related Rights (Neighboring Rights) Regarding the Moral Rights and Economic Rights of the Rebroadcast of the 2022 World Cup Broadcast Broadcast by Television Stations in Indonesia is carried out by applying for an implementation permit in advance to the KPI before carrying out the broadcasting activity. Monitoring and supervision of the broadcast of the World Cup in Indonesia will be carried out by the DJKI of the Ministry of Law and Human Rights as a form of commitment to provide legal protection to every holder of Intellectual Property Rights.
